Consent and Release

Agreement to Participate in City Soccer Programs and/or Crescent City Soccer Adult Leagues

The Agreement (“Agreement”) hereto is IN CONSIDERATION of a minor (“Participant”) registration and permission to participate in any way in City Soccer Programs and/or Crescent City Soccer Adult Soccer Leagues (“Activity”)

Participation in physical activity and exercise is inherently dangerous, and it is impossible to ensure the safety of all participating individuals. Participant understands and accepts this statement. Participant HEREBY RELEASES, DISCHARGES, AND COVENANTS NOT TO SUE City Soccer Programs and/or Crescent City Soccer Adult Soccer Leagues, or the associated representative administrators, directors, agents, officers, members, volunteers, employees, other participants, partners, sponsors, advertisers, and if applicable, owners and lessors of the premises on which the Activity takes place, (each considered one of the “RELEASEES” herein) from any litigation expenses, attorney fees, loss, liability, damage, or cost which may incur as the result of such claim.

Participant understands ACTIVITY INVOLVES inherent dangers, including but not limited to risk of SERIOUS BODILY INJURY, INCLUDING PERMANENT DISABILITY, PARALYSIS, AND DEATH (“RISKS”) and risks may be caused by my own actions or inactions, the actions or inactions of others participating or not participating in the Activity, the condition in which Activity takes place, and/or THE NEGLIGENCE OF THE RELEASEES

With the understanding above, Participant HEREBY RELEASES, DISCHARGES, AND COVENANTS NOT TO SUE City Soccer Programs and/or Crescent City Soccer Adult Soccer Leagues, City Soccer Programs and/or Crescent City Soccer Adult Soccer Leagues representative administrators, directors, agents, officers, members, volunteers, employees, other participants, partners, sponsors, advertisers, and if applicable, owner and lessors of premises on which the Activity takes place, (each considered one of the “RELEASEES” herein) from any litigation expenses, attorney fees, loss, liability, damage, or cost which may incur as the result of such claim. FROM ALL LIABILITY, CLAIMS, DEMANDS, LOSSES, OR DAMAGES ON MY ACCOUNT CAUSED OF ALLEGED TO BE CAUSED IN WHOLE OR IN PART BY THE NEGLIGENCE OF THE “RELEASEES” OR OTHERWISE, INCLUDING NEGLIGENT RESCUE OPERATIONS AND I FURTHER AGREE that I WILL INDEMNIFY, SAVE, AND HOLD HARMLESS EACH OF THE RELEASEES

Participant additionally understands, in case of medical emergency, as perceived by on- site personnel, on-site personnel may seek emergency assistance, if assistance is perceived to be necessary, or potentially necessary, and participant will be financially responsible for any expenses involved with such perceived emergency, as it may relate to participant.

Participant agrees to follow any communicated or posted safety rules, and all rules common to the sport of soccer.

Participant agrees to report any unsafe practices, conditions, or equipment to the City Soccer Programs and/or Crescent City Soccer Adult Soccer Leagues instructor or manager on site. Participant agrees and warrants that if at any time conditions are believed to be unsafe, participant will immediately discontinue further participation in the Activity and notify City Soccer Programs and/or Crescent City Soccer Adult Soccer Leagues, via e-mail, and confirm notification by response of City Soccer Programs and/or Crescent City Soccer Adult Soccer Leagues, via e-mail confirming understanding of conditions believed to be unsafe.

Participant certifies that participant possesses a sufficient degree of physical fitness to safely participate in soccer, and understand participant is able to discontinue activity at any time he/she feels undue discomfort or stress.

As some City Soccer Programs and/or Crescent City Soccer Adult Soccer Leagues activities may include at-will attendance, Participant understands that participant may not be required to participate in activities. By willingly participating, participant has considered all special needs or limitations relevant to participant and certifies that Activity is suitable for special needs and limitations. Participant has considered any health-related conditions that might affect participant’s ability to participate in Activity and participant attendance is completely at-will. Participant has responsibly inspected the the facility and accepts its suitable condition for participation, by attending and participating in City Soccer Programs and/or Crescent City Soccer Adult Soccer Leagues activities.

Participant has read the preceding information and all preceding information has been adequately explained. Participant understands and accepts the risks associated with participation and voluntarily nature participating in above-mentioned activity. Participant assumes all inherent risks of the sport and of voluntary participation in City Soccer Programs and/or Crescent City Soccer Adult Soccer Leagues. (c) there may be OTHER RISKS AND SOCIAL AND ECONOMIC LOSSES, either known or not known to participant or Releasees, foreseeable or not foreseeable at this time; and participant FULLY ACCEPTS AND ASSUMES ALL SUCH RISKS AND ALL RESPONSIBILITY FOR LOSSES, COSTS, AND DAMAGES participant may incur as a result of participation in Activity.

Participants grants City Soccer Programs the right to use any image or likeness obtained at Activity for all purposes of media or otherwise deemed relevant by City Soccer Programs, especially to enhance and promote the program. Such images and likenesses may include participant. Images and likenesses may be displayed to the general public or privately through any means deemed relevant by City Soccer Programs; City Soccer Programs website social media accounts or pages, and promotional material, or other means. This right is granted with without compensation for use of said image or likeness of participant. If participant prefers image and likeness not be used, notification will be sent. Participant understands that notification does not guarantee non-use, but that it will be taken into account and efforts made by Activity not to include participant in images for the purpose.

PARTICIPANT HAS READ THIS AGREEMENT, FULLY UNDERSTANDS ITS TERMS, UNDERSTANDS THAT SUBSTANTIAL RIGHTS ARE GIVEN UP BY SIGNING, SUBMITTING REGISTRATION FORM OR, IN ACTION, BY ATTENDING ACTIVITIES AND AGREEMENT HAS BEEN MADE FREELY AND WITHOUT INDUCEMENT OR ASSURANCE OF ANY NATURE AND

INTEND IT TO BE COMPLETE AND UNCONDITIONAL RELEASE OF ALL LIABILITY TO THE GREATEST EXTENT ALLOWED BY LAW AND AGREE THAT IF ANY PORTION OF THIS AGREEMENT IS HELD TO BE INVALID THAT BALANCE, NOTWITHSTANDING, SHALL CONTINUE IN FULL FORCE AND EFFECT.

Waiver of Liability: In consideration of being permitted to participate in Activity, Participant, on behalf of self, family, heirs, and assigns, hereby releases all releasees from liability for injury, loss, or death while using any facility or equipment or in any way associated with participating in Activity, at any time, resulting or not resulting from negligence, by releasees. IN CONSIDERATION of being permitted to participate in any way in Activity, that participants understand the nature of the Activity and certifies that participant is qualified, in good health, and in the proper physical condition to participate in such Activity.

MINOR RELEASE: Participant and PARENT AND/OR LEGAL GUARDIAN OF MINOR UNDERSTANDS THE NATURE OF ACTIVITY AND THE MINOR’S EXPERIENCE AND CAPABILITIES AND BELIEVE THE MINOR TO BE QUALIFIED, IN GOOD HEALTH, AND IN PROPER PHYSICAL CONDITION TO PARTICIPATE IN SUCH ACTIVITY.

PARTICIPANT HEREBY RELEASES, DISCHARGE, COVENANT NOT TO SUE, AND AGREE TO INDEMNIFY AND SAVE AND HOLD HARMLESS EACH OF THE RELEASEES FROM ALL LIABILITY CLAIMS, DEMANDS, LOSSES, OR DAMAGES ON THE MINOR’S ACCOUNT CAUSED OR ALLEGED TO BE CAUSED IN WHOLE OR IN PART BY THE NEGLIGENCE OF THE “RELEASEES” OR OTHERWISE, INCLUDING NEGLIGENT RESCUE OPERATION AND FURTHER AGREE THAT IF, DESPITE THIS RELEASE, I, THE MINOR, OR ANYONE ON THE MINOR’S BEHALF MAKE A CLAIM AGAINST ANY OF THE RELEASEES NAMED ABOVE, I WILL INDEMNIFY, SAVE, AND HOLD HARMLESS EACH OF THE RELEASEES FROM ANY LITIGATION EXPENSES, ATTORNEY FEES, LOSS, LIABILITY, DAMAGE, OR COST ANY MAY INCUR AS THE RESULT OF ANY SUCH CLAIM. PARENT/GUARDIAN CONSENT AND RELEASE OF LIABILITY FOR MINOR PARTICIPANTS
